Alaska Peacemaker Militia Leader Schaeffer Cox In Court On Weapons Misconduct Charge, Attempts To Serve Papers On Judge Patrick Hammers In Fairbanks

When Alaska militia leader Schaeffer Cox first stepped forward to publicize his militia activities, it appeared he was going to defy the negative stereotypes of militias commonly portrayed by the Southern Poverty Law Center. Cox came across as a positive, articulate, and rational spokesman for the militia movement. As a result, he was entrusted with the leadership of the Alaska Peacemakers Militia as well as that of the Second Amendment Task Force.

On Wednesday March 17th, 2010, Cox was arrested by Fairbanks police. The situation began when Cox was contacted by a local homeowner who complained that police were making an unauthorized search of her property. Cox was the first person to arrive at the home after the owner complained that police were searching her home without permission. Cox showed up to monitor the situation as part of the Liberty Bell network, which sends out mass notifications when someone believes their rights are being violated. While Cox was standing outside the home taking notes, police say he failed to tell them he was carrying a concealed .38-caliber pistol. He was arrested on a charge of fifth-degree weapons misconduct, a misdemeanor. Cox claimed differently; he said after Sgt. Gary Yamamoto contacted him and seized a small folding knife, he raised his arms and told Yamamoto that he was carrying a pistol. He said the notification occurred “within a matter of seconds” of contact between the two men.

Believe it or not, prosecutors decided to proceed with charges on this flimsy case. So on Wednesday December 15th, Cox appeared before District Court Judge Patrick Hammers in Fairbanks. But instead of pleading his case, Cox suddenly decided to serve criminal papers and a restraining order from a “de jure court” on the judge. Clerks refused to accept the documents for filing because some of the sheets of paper were printed on larger, legal sheets rather than the usual 8-by-11 paper. When Cox and an entourage of a half-dozen militia members attempted to follow Judge Hammers into his chambers, Alaska State Troopers physically intervened. Cox then allegedly told the troopers that the militia has the troopers "outmanmed, outgunned and we could probably have you all dead in one night", although he quickly added that he couldn't shoot someone who lived in the same town as him. Before going to his chambers, Judge Hammers set a December 28th trial date on the weapons charge.

So it seems like Schaeffer Cox has progressed from the militia movement, which is on solid ground emphasizing emergency preparedness and self-defense, to the sovereign citizens movement, which is extremely shaky and infested with loonies. "Sovereign citizens" believe Americans are sovereigns, or kings and queens, and no one is required to obey laws unless not doing so would directly harm other sovereigns. Much of their claims center around the belief President Abraham Lincoln subverted the original Constitution and replaced it with a copy that incorporated the United States. An extreme example of the sovereign citizens movement was the Montana Freemen, who were filing million-dollar liens against county clerks, attempting to pay debts with so-called "certified fractional reserve checks", and who ultimately holed up on a ranch and held off authorities for 81 days in 1996. They started off by trying to "serve papers on judges".

Reaction to stories published in the Anchorage Daily News and the Fairbanks Daily News-Miner shows absolutely no sympathy for Schaeffer Cox. Some sympathy expressed on VNN Forum. If his intent was to garner public support, he's failed miserably at this point. Many people are even poking fun at him. Cox needs to put this sovereign citizens nonsense on ice for the time being and get back to fighting this misdemeanor charge. This charge is clearly bogus, as Fairbanks police targeted him primarily because of his militia activities, but he's going to end up talking himself into jail if he doesn't get back to resolving the issue. He's already pissed off the judge, who can determine his fate.

  2. Sovereignty of the People

    The concept of sovereignty stands on its own. The sources shown below may help you to see that it is a respected and valid concept. (It is the Law, not an opinion.) When the Supreme Court rules it substantiated as law and fact, no court can rule differently and must follow the ruling. There are NUMEROUS other Supreme Court cases following the same sovereignty of the people ruling. "We the People" do ..... ordain and ESTABLISH this constitution... should be a clue to the intent of the people. "all governmental powers come from (we)the people.."

  3. I personally reviewed the original audio recording and written report of the incident (by Sgt. Gary Yamamoto). In listening, timing, and analyzing the audio recording, I found that Mr. Cox IS truthful in his accounting of the time frame, and the events that occurred in this incident. (I am an audio/acoustic engineer with over 30 years experience.) I can also state, under penalty of perjury, that Sgt. Yamamoto was untruthful in his written report of the incident multiple times.

    Apparently the author of this article believes that the Supreme Court Justices who have ruled numerous times that "we the People" ARE the sovereigns in this nation are part of that same "...extremely shaky and infested with loonies.." Lunatic Fringe group.
    My question is - who would be the "loonies" - the people who want America to get back to its former honesty and glory, standing in TRUTH (Constitution), or sell out to a despotic "government" which destroys its own people for the benefit of a few.

  5. I hate to report this as I kind of liked this guy, but I saw it coming. His anger, his ego, his over estimate of his 3,000 person militia. He should have fought with words and Ideas and played a perfectly straight game. Even if you are perfect you also need big money and some insiders and great chess player political warriors in your corner to fend off frames and such. I read about and talk to our associates. Those arrested and those killed in Action and they all make similar mistakes. I study what different rebels do and many just make stupid moves and obvious errors. He should have just went to court and dealt with the misdemeanor charges and continued to preach his message and built numbers. Once he started a new gov (CoS), courts, liberty alert, etc., he had to play a perfect game, have a full time cameraman/recorder, many witnesses and stay away from anything illegal. Or at least do alone...??? :) also look at Cox court appearance on youtube. Interesting!
